CBT Litigation Update: Settlement Reached

Local 2118 is pleased to announce that the Union and Company reached a settlement regarding the Union’s lawsuit over the three non-FAA computer-based trainings (CBTs) and the Company’s unilateral establishment of the pay rate for these trainings.

Based on the terms of the settlement, the Company’s determination of the pay rate for this training is not the final word. Instead, the Company will pay the pilots what it stated it would pay them in the January 4, 2025, notice, while the parties meet to determine what additional compensation, if any, must be payable to pilots for completing these three courses. If the parties are unable to mutually agree upon the amount of compensation payable to the pilots, then the matter will be submitted to an arbitrator, who will then decide the amount of the compensation. Pilots have until March 1, 2025, to complete the Preventing Harassment and Discrimination, the Allegiant Team Member Handbook, and the Allegiant Code of Conduct and Ethics CBTs.  Any Company communications/CBT software messages regarding a January 30, 2024 completion date are superseded by the Settlement Agreement.

Note that this Settlement Agreement is limited to the three courses identified above. The Union reserves all its legal rights to challenge the Company if it seeks to impose any other non-FAA-required home study CBT. Also, as part of the Settlement Agreement, the Union’s withdrawal of the lawsuit is without prejudice; meaning the Union can file the same claim in the future.

The Settlement Agreement expires when the CBA that we are currently negotiating takes effect. A copy of the Settlement Agreement can be found here.

Separately, the FAA-required Hazardous Materials Recognition and Fatigue Program CBT must be completed by January 31, 2025. Pay for this FAA-required CBT is in accordance with Section 3.Q of the CBA. Pilots should complete this training by January 31, 2025.

Negotiations Update: Meetings Before Mediation

Next week Negotiating Committee Member Jim Cole and Union Subject Matter Expert (SME) Mark Roberts are meeting with Company SMEs to work on PBS-related issues. Assuming the meetings are productive, this is a positive development that should advance the pace of negotiations over the remaining issues in Section 15 (Scheduling) and the PBS Letter of Agreement.

As previously reported, mediation resumes February 18-20.
